Peter Cheatham b.c. 1751 in Va., d.c. 1785, m. Elizabeth Thurmond, b. 1759 in Albermarle Co., Va., d. 1817 in Edgefield Co., S.C. Elizabeth Thurmond was a daughter of John and Elizabeth Thurmond. Both families moved to SC after the American Revolution. John and Elizabeth Thurmond are ancestors of Senator Strom Thurmond of SC and the late Senator Herman Talmadge of GA.

The children of Peter and Elizabeth Cheatham follows.
 

1. John F. Cheatham, Sr. b. 1775 in Virginia, d. 5/10/1842, m. Mrs. Fannie Talbert Key (first husband was William Key who d. 1802). John and Fannie lived in Edgefield District and raised a large family.
 

2. Guttridge Cheatham, moved to Alabama. Will follow below.
 

3. Mary Cheatham b.c. 1780 in Virginia, d. 8/27/1850, m. William Strom, Sr. (second wife), William had a son John by his first wife, b.c. 1768 in America, d. 11/23/1839. Mary Cheatham and William Strom are ancestors of Senator Strom Thurmond of SC. William and Mary lived in Edgefield District and raised a large family.
 

Guttridge (Gutridge, Guthridge) and Elizabeth Cheatham were the first members of this family to come to Butler County. They left Edgefield District, SC and first settled on Pigeon Creek (around 1825) east of Moriah Church near where I-65 crosses the creek. There is an Elizabeth Cheatham (#50 member) listed in the minutes on June 16, 1832 for Moriah Church. She must be the wife of Guttridge Cheatham. Guttridge was born 1776 in VA and died December 1865 in AL.

Elizabeth Cheatham was born 1780 and died after 1850 but before 11/9/1854 when Gutridge Cheatham made his will. A copy of his will appears at the end of this chapter.

They later moved southeast of their first farm to a new farm that was located on the Old Stagecoach Road (US 31 highway). This is approximately 7 miles north of Greenville on the U.S. 31 highway where Gibson Road intersect U.S. 31. My grandfather and grandmother, Richard O. and Eula Bay Simmons Cox told me that his slave quarters was close to this intersection. Indian Hill Church, a black church, is located a short distance from this intersection. His slaves may have started the church and cemetery.

Guttridge was a private in Captain Keys Company, South Carolina Militia, War of 1812. I have the patent for 40 acres of land, dated 4/1/1852, received for this service and the deed with his signature when he sold this land to John Talley. Also, Guttridge Cheatham is listed as a Lieut. in Austin's Regiment SC Militia.
 

Guttridge and Elizabeth were the parents of ten children. The children will now be listed in order given in his will. Separate chapters on some will follow this chapter.
 

1. Judy Cheatham (#87 member at Moriah Church) married William Mosley (#86 member at Moriah Church). They lived east of the railroad in the Searcy Community. Their children were:
 

1. 1. James Albert Mosley was born 9/4/1815 in Edgefield District and died 10/25/1876 in Madison County, Texas. Buried in Old Bethel Cemetery, Grimes County, Texas. James Albert served as a Texas Ranger during the Civil War.
 

1. 2. Gutridge Mosley was born 6/26/1817 in Edgefield District, m. Lucinda

Harrison b. Dec. 1820 on 8/25/1841 who was a daughter of Jonathan and Barbara Harrison #35 and #36 (member at Moriah Church), and died 9/15/1864. Their children were:

1. 2. 1. William Mosley was born 10/30/1842, married Missouri A. Adams

Simmons (b. 12/27/1849 and d. 1/21/1917) on 11/7/1872, and died 8/3/1917. Both are buried at Antioch East Baptist Church. They had only one child.

1. 2. 1. 1. Oma Mosley b. 1/4/1889, d. 11/11/1983 and m. Ernest Cates on 11/29/1914. Ernest was b. 9/27/1887 and d. 6/20/1937. Ernest and Oma had two children:

1. 2. 2. Elizabeth Mosley b. 7/26/1844, m. 1st W. P. Hicks on 5/6/1875 and m. 2nd Isaac Grant, his second wife. See the Harrison Family, 1.17.

Mary C. Cheatham on 11/21/1869 and m. 2nd Mrs. Rachel Whittle Hartley. See Harrison Family. Jonathan and Rachel had one son.

1. 2. 4. 1. John Colon Mosley who was born on 5/13/1891 and died 4/22/1958. He married Ethel Martin (b. 11/13/1892 and d. 3/4/1969) and they had eight children.

Allen died during the Civil War and Jane m. second William A. Graydon, Jr.. William and Emma Boddie are buried at Spring Hill Methodist Church Cemetery near the graves of Jane E. Graydon and Catherine Jane Simmons. Jane E. Simmons was a daughter of Eli A. Simmons, Sr. and his first wife. Allen was a son of William Boddie who was a son of Allen Boddie of Edgefield District, SC. William Boddie was the father of Catherine Jane Boddie who first m. Jeremiah Forehand and m. second Eli A. Simmons, Sr. See the Boddie Family for more information. Emma and William Eli had two children.

District and died 10/3/1884. His wife was Eliza Ann, b.c. 1824, and they lived in Lowndes county in 1840. According to the 1870 census they were living on the former Gutridge Cheatham estate. Their children were:

Cleveland, TN during the Civil War.

Gresham on 1/1/1868. Beatrice was b. June 1847 and was probably a daughter of Lorenzo Gresham who was the 2nd husband of Martha Seale Cox. She was born 10/6/1847 and died 9/18/1919. They had 11 children.

According to Book 21, p. 331-333, Probate Minutes of Butler County they were living with their mother, Mrs. Ida Hall in Lowndes Co. Mrs. Ida Mosley m. 2nd Thomas E. Hall and they had two children by 1900: Guy Hall b. July 1897 and a baby daughter b. May 1900. Was Thomas Hall b.c. 1851 a son of Harriett Hall b.c. 1810, house #641, 1870 Census of Butler County?

Deletha McCoy was a daughter of Joseph and Frances McCoy of Henry County, Alabama. Joseph McCoy was a brother of John McCoy, Sr. of Butler County, Alabama. See the Harrison and McCoy Families.

Nancy McCoy on 1/16/1853, a sister of Elizabeth McCoy the wife of Robert Mosley above. In 1850 Daniel was living with Robert and Elizabeth Mosley. Nancy was born 4/9/1829 in Kershaw County, S. C. and died 5/17/1911. Daniel is not listed on the 1860 census and Nancy and her family were living in Butler Springs. Their children were:

Julian and his family were living next to his mother in 1900. Calvin V. Gibson (a nephew) was named the administrator of Callie Mosley's estate on 11/16/1901. See Vol. 20 of the Estate Records for Butler Co. Ida Mae Gibson told me that Joseph Blackman (father of Carolina) would not let Julian and Carolina marry in the house. There may have been a racial problem. They were married in front of the house by the road.

1. 9. 5. Rebecca Catherine b. 10/25/1863. She was a mulato. Daniel was dead and I do not know who her father was. Rebecca and her mother Nancy lived east of the voting house on the left before reaching the sharp curve to the right. Rebecca worked for Eli Simmons and married a Crysel who was white. However on the 1900 census she was not living with him but with her mother. Uncle Sam Gibson said that as a child he walked over to their house with his mother Cora Cheatham Gibson. Rebecca is buried at Spring Hill Methodist Church. Rebecca m. Henry Crysel on 8/26/1884. Henry d. 12/2/1889.

3. Mary "Mollie" Cheatham b.c.1806 and married Zadock Talley b.c. 1805. They bought land (75 acres) in Section 36, Township 12 Range 11 in Wilcox Co., Alabama on 12/8/1831 from the U.S. Land Office. They later moved to Mississippi and on March 15, 1854 Zadock Talley purchased land (120.67 acres) in Section 18, Township 10 N and Range 13 E in Neshoba County, Mississippi from the U.S. Land Office. Zadock Talley was a son of William Talley and Elizabeth Bussey. See Talley Family. According to the 1850 Census for Neshoba County, Mississippi their children were:

William Talley (member #5 at Moriah Church) purchased land, W 1/2 and E 1/2 of NE 1/4 of S 8 TS 11 R 15, on 10/9/1824 and 1/20/1826 in Butler County, Alabama. Elizabeth Bussey was the wife of William Talley. William Talley was one of the organizing members of Moriah Church. William Talley transferred his letter in 1831.

William Talley was a first cousin of Guttridge Cheatham. The mother of Guttridge Cheatham had a sister Nancy Ann Thurmond who married Nathan Talley, Sr. and they were the parents of William Talley.
 

According to the 1830 Census of Butler County we have the following for William Talley: 2 males between 5 and 10, 1 male between 20 and 30, 1 male between 40 and 50, 2 females < 5, 1 female between 10 and 15, 1 female between 15 and 20, 1 female between 40 and 50 and 4 slaves.
 

William Talley joined Mt. Moriah Baptist Church by letter on 6/4/1831. William Talley and his family are listed on the 1840 and 1850 Census of Wilcox County, Alabama. On 2/27/1854 he purchased land in Neshoba County, Mississippi. On the 1850 Census for Wilcox Co., House # 649, we have

From Edgfield County, SC we have the following. The will of Zadoc Bussey was signed 1/3/1822 and probated 11/2/1825. His wife was Nancy, his sons were George, John, and Emmerson, and his daughter was Elizabeth Talley. This Elizabeth Talley must be the wife of William Talley.
 

William Talley b.c. 1788 in Edgefield District, SC, and d. 6/13/1865 in Philadelphia, MS. He m. Elizabeth Bussey about 1808 in SC who was a daughter of Zadock and Nancy Bussey. Their children were:

First, Mary Catherine Talley b.c. 1815 in SC, d.c. 1842 in Butler Co., Ala., m. George Chancellor on 1/5/1836 in Wilcox Co., Ala. George was a son of Gilbert Chancellor, Sr. and Catherine Harrison. See Chancellor Family and Harrison Family.

Second, Zadoch Talley married Mollie Cheatham, a daughter of Gutridge Cheatham. Zadoch Talley purchased land in Section 36 TS 12 R 11 in Wilcox County, 12/8/1831. William Talley purchased in Section 24 TS 11 R 11 in Wilcox County, 10/9/1835. There is a Mrs. Talley and a T. Talley listed on the 1840 Census for Wilcox County, Alabama.

Third, Nathan Talley b.c. 1810, d.c. 1864, and m. Perminda Hill on 3/29/1835 in Wilcox Co., Ala.

Fourth, Dorah A. Talley b.c. 1812, d.c. 1858, m. 1st Mr. Strum and m. 2nd D. T. Weatherford. She was in Florida by 1850.

Fifth, Caleb Talley born 6/15/1824 and died 11/2/1868 was a son of William and Elizabeth Talley. Caleb Talley married Nancy A. Day who was born 2/17/1825 and died 9/17/1863. She was a daughter of Frederich and Susannah Day. Caleb and Nancy A. Day Talley had a daughter Frances Ann Talley who married William McCain on 12/4/1881. See the Frederick Day Family.

Deed Book H, page 453, Butler Co., Greenville, Alabama. Gutridge Cheatham gave to Elizabeth A. Sheppard a negro girl named Amanda aged 7 years for $1. Sept. 3, 1838.
 

Jasper Rodgers was a son of Henry (or Harvey) Rogers b.c. 1804 in TN. and Sarah, b.c. 1807 in Ga. Their children were Jasper b. in Ala, Wesley b.c. 1828, James b.c. 1831, Morgan b.c. 1836, Henry b.c. 1842, Amanda b.c. 1830, Lucy Ann b.c. 1838, Ella Pinkney b.c. 1844, Nanny b.c. 1846 and Pane b.c. 1848.
 

William Sheppard purchased land about a mile east of Spring Hill Methodist Church: NW 1/4, SE 1/4, and SW 1/4 of NW 1/4 Sec. 25 T 11 R 15, SE 1/4 of SE 1/4 Sec. 25 T 11 R 15, NE 1/4 and SE 1/4 of NE 1/4 Sec. 26 T 11 R 15, SE 1/4 of NW 1/4 Sec. 26 T 11 R 15. They probably lived there.
 

It appears that after Elizabeth died William Sheppard m. 2nd Elizabeth Collins Oliver the widow of Andrew Oliver who drown in Mobile Bay and a daughter of William Collins. The estate of William Collins shows that Elizabeth Collins had a daughter, Ellen Oliver who m. Jeremiah Dudley on 12/23/1846 in Lowndes Co., and a son, Andrew C. Sheppard. See the estate records for William Collins in Book 3 of Probate Records. Francis Sheppard was the Administrator of the estate. William Tillery and Ross Callen were the Witnesses.

6. Peter Cheatham married Melinda Holmes of Twiggs County Georgia. They lived in the Fort Dale area and they are buried at Fort Dale Cemetery. See the chapter on Peter Cheatham.
 

7. Daniel H. Cheatham b.c. 1810, married Elizabeth Hetty Reddock b.c. 1808 who was a daughter of Alexander and Hetty Reddock, and they lived in the Reddock Springs Community. See the chapter on Daniel Cheatham.
 

8. Guttridge Cheatham, Jr. wife was Glady #150 and #269. Glady Cheatham joined Moriah Church on 5/18/1844. On the 1850 Census Guttridge Cheatham, Jr. wife is given as Lydia of age 30 and born in Georgia. Gladys and Lydia must be the same person. Guttridge, Jr. was dead by September 1866 and Glady died in 1871. Their children were:

They are the children of Gutridge, Jr. and Gladys Cheatham. Signed on April 2, 1851 by G. Cheatham, Sr. and witness by William Graydon and Samuel H. Sheppard.
 

9. Nancy Cheatham b.c. 1817 in SC and married William B. Stewart. William was b.c. 1817 in GA and Nancy was dead by November 9, 1854 when Guttridge Cheatham, Sr. made his Will. From his Will: To my daughter Nancy Stewart, I have already given a negro woman named Caroline valued by me at $600, and my daughter having died leaving only one child, and the woman Caroline having had several children, I hereby declare that the said child of my daughter Nancy Stewart is not to receive anything more from my estate. From the Probate Records: Nancy left one heir named Virgil Stewart b.c. 1846 in LA. There is a V. A. Stewart who m. Henrietta Wood on 1/12/1870 in Butler Co., Alabama.

William B. Stewart purchased land a short distance from Guttridge Cheatham's house and adjacent to his farm. The land purchased by William B. Stewart is west of the farm of Raymond Gibson located on Gibson Road. In the 1950s there was an old log house located nearby. We called it the stack chimney house. At that time Noon and Bert Frost (a black family) lived in it.

In this cause, it is made to appear to the Register, by the affidavit of Complainant, Walter H. Barganier, that the defendants, M. E. Cheatham and S. E. Cheatham are each over the age of twenty one years and that from information and belief they reside in Madison County, Texas, that their post office address is Zuloh, Madison County, Texas; that the defendants, I. P. Cheatham, L. C. Cheatham, A. M. Cheatham, Arch Cheatham, R. L. Cheatham, Mary C. Cheatham, Hervey Cheatham, Mary Buhlberg, J. W. Cheatham, Hester Buckhaults, R. T. Cheatham, E. L. Cheatham, Nannie Walton and Eva Pass, the age of each being unknown to affiant and from information and belief they each reside in Madison County, State of Texas and that the post office address of each is Zuloh, Madison County, Texas.

It is therefore ordered by the Register, that publication be made in the Greenville Advocate, a newspaper published in Greenville, Alabama, once a week for four consecutive weeks, requiring them, (the people named above) to answer or demur to the bill of complaint in thiscause by the 9th day of January, 1920, or in thirty days thereafter, a decree pro confesso may be taken against the adults and a Guardian ad litem appointed for the minors, in this cause.

In the name of God, Amen. I, Gutridge Cheatham do hereby make and declare this my last Will and Testament, being of sound mind and discretion and I hereby revoke and make null and void all other and former Wills, Testaments and Codicils by me at any time heretofore made.

First. I resign my soul into the hand of God, who gave it, trusting to the merits of a merciful Saviour, for that peace and felicity beyond the grave which can never be attained here and my body I commit to the earth desiring my Executors to give it a decent and appropriate burial.

Secondly. To my daughter Judy Mosley, widow and relich of William Mosley, I gave in her lifetime a negro woman named Maria and her child, Ellen, rated by me at $700. To my son John Cheatham, now deceased, I gave in his lifetime one negro man named Squan valued by me at $700. To my daughter Mollie Talley, wife of Zadock Talley, I have already given a negro man named Mike valued at $700, also a boy named Wily and a girl named Herena, the last two rated at $700, making in all given to her the sum of $1400. To the children of my deceased daughter Elizabeth Sheppard, wife of William Sheppard, deceased, to wit: to Daniel Sheppard, James Sheppard, Gutridge Sheppard, and Elizabeth Rodgers, wife of Jasper Rodgers, formerly Elizabeth Sheppard, I have given $800 or have it to give to them in money which shall be done in a few days, and I have given to Elizabeth Rodgers above named a negro woman named Amanda, as compensation for living with me and for which she is in no way to account in the settlement of my estate or otherwise. To my daughter Patience McCoy, wife and relick of Robert McCoy, deceased, I have already given a negro woman, named Charity and Wyatt her son and George her son and a negro boy named Jordan, all rated at the price of $1300. To my son Peter Cheatham, I have already given a negro man named Hampton, a negro boy named Bill, and Emily a negro woman, altogether rated by me at $1400. To my son Daniel H. Cheatham, I have already given a negro man named Surry and a negro boy named Henderson and a negro girl named Diana, rated by me at $1250. To my son Gutridge Cheatham I have already given a negro man named Bob and a woman named Edna, and some land which altogether is rated by me at $1500. To my daughter Nancy Stewart, I have already given a negro woman named Caroline valued by me at $600, and my daughter having died leaving only one child, and the woman Caroline having had several children, I hereby declare that the said child of my daughter Nancy Stewart is not to receive anything more from my estate. To my son Archy Cheatham, I have already given a negro man named Frank and Mary, a negro woman, and a boy, Cloe, and five eighty acre tracts of land, altogether valued by me at $1560.

Thirdly, I desire my Executors, after my death, to sell my property and first pay all my debts and the expenses of settling my estate and paying my Executors reasonable compensation for attending to the settlement of my estate, then with the proceeds of the estate so sold, I wish then to pay over to each one of my children, and to the heirs of my deceased children, except the child of Nancy Stewart such sum as shall make up to each a portion equal in value to that heretofore given to Archy Cheatham.

Fourthly, With the balance left on hand after complying with the last preceding clause, I wish my Executors to pay Daniel H. Cheatham $134 for compound interest which he has had to pay to the two youngest heirs of John Cheatham, deceased, and charge the same amount as so much received by them the balance left after this payment to Daniel Cheatham, is to be divided equally between my children and grandchildren above named, (except the child of Nancy Stewart) each set of grandchildren to receive only what would have been a parents portion under all the clauses of this will.

Fifthly, It is hereby directed that in estimating the different shares of property heretofore given off by me, no interest is to be charged on heirs on use of property, but the amounts are to be taken just at the amounts named in this my will.

Sixthly, I hereby constitute my two sons, Peter Cheatham and Daniel H. Cheatham my Executors of this my Last Will and Testament. All other Wills and Testaments by me made having been revoked by me.

In witness whereof I have hereunto set my hand and seal, this the 9th day of November 1854. Signed, sealed and published as and for my Last will and Testament in the presence of, the words "given and died" inserted before signing

My grandfather Richard Odom Cox (grandson of Odom Cox) and my grandmother Eula Simmons Cox (great granddaughter of John R. McCoy) told me that there was a double wedding at Gutridge Cheatham's house. For the wedding a punch was prepared and the slaves own by Gutridge Cheatham added some poison berries to it. They did not know what happened. They also said that in his old age, Gutridge would sit in a chair under a tree and kill the ants with his walking stick.
