October Term 1851
The State of Alabama ~ Fayette County
Probate Court 1st day of October AD 1851 the following
proceedings were had to with:
ISHAM ALDRIDGE ESTATE
{ Order of Sale of Real Estate
Come this day CHARLES COCK,
administrator of all and singular the goods and charity rights and
credits of Isham Aldridge
late of said county, deceased, who at a former day petitioned this
court to grant an order of sale of real estate belonging to said
deceased for the purpose of making an equal division of the ____ among
the heirs of said Estate. Said real estate is described on said
petition as the E½ of the SE¼ Sec 19 and the W½ of
the SW¼ Sec 20 and the E½ of the NW¼ and the
NW¼ of the SW¼ Sec 28 – all in Township 14 – Range 11
West lying and being in the county aforesaid [see map of area here]. Said Cock
administrator as aforesaid further showing that JAMES L. ALDRIDGE, MARTIN W ALDRIDGE, ISHAM P ALDRIDGE, POLLY ALDRIDGE (a lunatic),
PRICE M JOHNSON the
husband of NANCY, ASHLEY ALDRIDGE the husband
of CELIA, CHARLES
COCK the husband of MAHALA,
and WILEY A KILGO the
husband of REBECCA
are the sole heirs of said estate, and are twenty-one years of
age. And of appearing to the satisfaction of the court that
notice has been given in the Tuscaloosa
Observer, a newspaper printed in the city of Tuscaloosa
requiring all persons interested in said estate to appear on this day
and make exceptions or ___ against said petition if they should think
proper. And it further appearing to the satisfaction of the court
that citation has been issued to and served on MARK RUSSELL, Guardian Ad
Litem for POLLY ALDRIDGE (a lunatic), MARTINE W. ALDRIDGE, ISHAM P.
ALDRIDGE, PRICE M. JOHNSON, ASHLEY ALDRIDGE, WILEY A. KILGO, ANNA
ALDRIDGE, CHARLES COCK, and JAMES L. ALDRIDGE not
____ in this state and further appearing to the satisfaction of the
court that the said MARK RUSSELL was ____ to with on the 16th day
of August last past duly appointed Guardian Ad Litem for the said POLLY
(lunatic) and that he has due notice of said petition, and neither the
Guardian Ad Litem or the heirs having appeared on this day as they were
bound to do if
they thought that proper, to defend against said petition, or say
anything against the prayers of said petitioners. No objections
being made to said petitions or any part thereof. It is therefore
ordered by the court that said land be sold as alleged and decreed in
said petition and for the purposes therein _____. And in further
appearing to the satisfaction of the court that the said CHARLES COCK
has executed ___ in the ___ sum of seventeen hundred dollars conditions
as the law directs. With MARK RUSSELL and MARTIN ALDRIDGE or his
securities ___ which _____ is hereby approved and ordered to be filed
and recorded.
It is further ordered and decreed that the said
CHARLES COCK, administrator as aforesaid be and he is hereby authorized
to make sale of the aforesaid real estate as mentioned in said petition
at public auction after notice in such case made and provided, to the
highest bidder on a credit until the first day of March 1853 the
purchaser giving note with approved security, and a due report of his
proceedings, make under this order to this court on the second Monday
in December next and then the court adjourned.

10th October 1851
ISHAM ALDRIDGE’S ESTATE
{ Ret. Of sale of cattle, rent of lands for 1851, and money in
{ hand. 10th Oct. 1851
Come this day CHARLES COCK, administrator of all and
singular the goods and charter rights and credits of Isham Aldridge
late of said county deceased and make return of the inventory of sale
of cattle rent of land and money on hand, belonging to said Estate,
which inventory being sworn to by said administrator and examined by
the court.
It is therefore ordered that said Inventory be and
the same is hereby received ordered to be filed and recorded.
And thus the court adjourned

ISHAM ALDRIDGE’S ESTATE
{ Ret. Of Int. of sale of Real Estate Ret 2nd Febr. 1852
Come this day CHARLES COCK Administrator of all and singular the goods
and charter rights and credits of Isham Aldridge late of said county
deceased. And make return of the Inventory of sale of real
Estate: which inventory of sale being sworn to by said Administrator
and examined by the court.
It is therefore ordered by the court that said
inventory of sale of real estate is this day returned by said
Administrator be and the same is hereby approved ordered to be filed
and recorded.

ISHAM ALDRIDGE’S ESTATE
{ Papers filed for final settlement 29th August 1853 and to be made
19th Oct 1853
This day CHARLES COCK Administrator of the Estate Isham Aldridge late
of said county decease filed his account current and vouchers for a
final settlement of said Estate.
Ordered by the court that notice is hereby given to
all persons interested in said Estate to appear at a court of probate
to be holder at the court house in and for said county on the 19th day
of October next if they -should think proper and contest said account
in final settlement, at which term of said court the undersigned Judge
will proceed to make said final settlement. It is further ordered
that the same be advertised in a newspaper published in said county for
three successive weeks previous to said day of final settlement.
It is further ordered the MARK RUSSELL be __ he is
hereby appointed Guardian Al Litem for POLLY ALDRIDGE (a lunatic) to
attest to interest in said final settlement. And thus the court
adjourned.

Court 19th October 1853
The following proceedings were had to with:
ISHAM ALDRIDGE’S ESTATE
{ On Final Settlement with CHARLES COCK Adm
{ 19th October 1853
Be it remembered that on this the 19th day of
October 1853 before the Probate Court of said County, came CHARLES
COCK, Administrator of all and singular the goods and charter rights
and credits of Isham Aldridge late of said county deceased. And
prays that his account as stated and presented to this court for
allowance the 20th day of August last, and reported to this present
term for allowance, be allowed. And it appearing to the
satisfaction of the court that a notice of the intention of the said
CHARLES COCK Administrator as aforesaid, to have his account stated as
aforesaid, and presented to this presented to this present term for
allowance, has been advertised in the Fayette Banner, a newspaper
published in the Town of Fayetteville for three successive weeks
previous to this present term of the court: And further appearing
to the satisfaction of the court that MARK RUSSELL of said county has
been duly appointed Guardian Ad Litem for POLLY ALDRIDGE one of theirs
of said Estate who is of unsound mind. To appear on this day at
said court, and protect said POLLY ALDRIDGE’s interest is said
settlement which notice has been issued to and served upon said MARK
RUSSELL Guardian Ad Litem as aforesaid and the court proceeding to a
consideration of said account as reported at this present term for
allowance: and no exception being made to the sum or any
part thereof, by the heirs or Guardian Ad Litem. And it appearing
to the satisfaction of the court, that by said account stated as
aforesaid and presented to this present term for allowance. That
the said CHARLES COCK Administrator as aforesaid is chargeable with the
sum of twelve hundred and fifty eight dollars and twenty cents.
And entitle to credits to the amount of one hundred and fifty eight
dollars and forty five cents. Leaving a balance against the said
CHARLES COCK Administrator as aforesaid of one thousand and ninety nine
dollars and seventy five cents. Therefore it is ordained and
decreed by the court that said account of the said CHARLES COCK
Administrator as aforesaid be allowed as stated as aforesaid and that
the serve with all the vouchers thereto belonging be filed and recorded.
It is further ordered and decreed that the said
CHARLES COCK Administrator aforesaid proceed to make ____ of the ___
sum of one thousand and ninety nine dollars and seventy five cents,
among those entitled thereto in the manner and --- following:
That is to say.

decreed to pay over to him the said James L. Aldridge, and for which
execution may
issue. |

To MARTIN W. ALDRIDGE one of the heirs of said Estate the sum of one
hundred and twenty two dollars and eighteen cents, which is here by
issued and decreed as his distributive share of said Estate, and which
the said Charles Cock Administrator of said deceased is decreed to pay
over to him the said Martin W. Aldridge, and for which execution may
issue. |

To ISHAM P. ALDRIDGE one of the heirs of said Estate the sum of one
hundred and twenty two and 18/100 dollars, which is here by issued and
decreed as his distributive share of said Estate, and which the said
Charles Cock Administrator of said deceased is decreed to pay over to
him the said Isham P. Aldridge, and for which execution may
issue.

To POLLY ALDRIDGE (of unsound mind) one of the heirs of said Estate the
sum of one hundred and twenty two and 18/100 dollars, which is here by
issued and decreed as his distributive share of said Estate, and which
the said Charles Cock Administrator of said deceased is decreed to pay
over to him the said Polly Aldridge, and for which execution may
issue. |

To ANNA ALDRIDGE the widow of said deceased the sum of one hundred and
twenty two dollars and 18/100 dollars, which is here by issued and
decreed as his distributive share of said Estate, and which the said
Charles Cock Administrator of said deceased is decreed to pay over to
him the said Anna Aldridge, and for which execution may
issue.

decreed as his distributive share of said Estate, and which the said
Charles Cock Administrator of said deceased is decreed to pay over to
him the said Price M. Johnson, in rights of his wife Nancy, and for
which he may have his writ of Execution to
issue. |

To ASHLEY ALDRIDGE in right of his wife SELAH ALDRIDGE one of the heirs
of said Estate the sum of one hundred and twenty two and 18/100
dollars, which is here by issued and decreed as his distributive share
of said Estate, and which the said Charles Cock Administrator of said
deceased is decreed to pay over to him the said Ashley Aldridge, and
for which execution may
issue. |

To CHARLES COCK in right of his wife MAHALA one of the heirs of said
Estate the sum of one hundred and twenty two and 18/100 dollars, which
is here by issued and decreed as his distributive share of said Estate,
and which he is hereby authorized to retain in his
hand. |

To WILEY KILGO in right of his wife REBECCA KILGO one of the heirs of
said Estate the sum of one hundred and twenty two and 18/100 dollars,
which is here by issued and decreed as his distributive share of said
Estate, and which the said Charles Cock Administrator of said deceased
is decreed to pay over to him the said Wiley Kilgo in right of his wife
Rebecca, and for which execution may
issue. |

It is further ordered and decreed by the court that
CHARLES COCK Administrator as aforesaid proceed to pay over to the
Judge of Probate the sum of nineteen dollars and ninety cents,
the ___ of the cost in __ final settlement and for which he had had
credit for in saw settlement and for which execution may issue and thus
the court adjourned
