Sumter County, Alabama Deed Book B, pp. 133 & 134 Ohoyo Tom & Moses Tom To Thomas Ware Received Augt 15 1836 and Recorded Nov 12 1836 This Indenture made the sixth day of July in the Year of our Lord one thousand eight hundred and thirty six between Ohoyo Tom and Moses Tom her husband of the first part and Thomas Ware of Sumter County of the second part; Witnesseth that the said party of the first part for and in consideration of the sum of Two Hundred dollars to them in hand paid by the said party of the second part the receipt whereof is hereby acknowledged , hath bargained and sold and by these presents doth bargained and sell unto the said party of the second part and to his heirs and assigns forever One Hundred acres of Land lying and being in section Number Thirty Two (fractional) to be laid off from the Southern part of said fractional section which is in Township Number Twenty one of Range Number one west in the Land District of Tuscaloosa Alabama the parties of the first part having this day conveyed Sally Tom Two hundred & twenty acres of Land to be laid off from the North part of said fractional section to include her houses. The land here conveyed being a portion of the land acquired by the said Ohoyo Tom under the 14 article of Treaty of Dancing Rabbit Creek together with all and singular the hereditaments and appurtenances thereunto belong belong or in anywise appertaining and the resision and revisions remainders and remainders rents issues and profits thereof and also all the estate right title interest claim or demand whatever of them the said party of the first part either in Land or equity of and in and to the above bargained premises and every part and parcel thereof To have and to hold to the said party of the second part his heirs and assigns forever And the said to the sale and only purposes use benefit and behoof of the said party of the second part his heirs and assigns forever. And the said party of the first part for themselves heirs assigns executors and administrators doth hereby warrant and will forever defend the title of the above bargained premises to the aforesaid Thomas Ware and to his heirs assigns free from the claim or claims of every person or persons whatsoever: as also from the claim of the General Government. Scott [marks] Notary Public The State of Alabama Sumter County Town of Gainesville Be it remembered that on the sixth day of July AD 1836 the within named Ohoyo [error] Tom personally appeared before me Christopher C. Scott Notary Public duly commissioned and qualified according to law and dwelling in the town of Gainesville aforesaid and acknowledged that he signed sealed and delivered the within deed on the day and year therein mentioned to the within named Ohoyo Thomas Ware Also, in like manner appeared the Ohoyo Tom his wife and Consort of the said Moses Tom who upon being examined by me privately and separate and apart from her husband ackn-owledged and declared that she signed sealed and delivered the within Deed freely and of her own accord and without any threat or compulsion on the part of her husband.
